  • the mobile application simREF
  • all associated services, integrations, and features, including:
  • SimBrief integration
  • Virtual Airline functionality
  • partner-based access models

3. Terms of Use

3.1 Purpose of simREF

simREF is a software product designed exclusively for flight simulation use.

It is not intended for:

  • real-world aviation operations
  • flight training
  • operational decision-making
  • real aircraft dispatch or navigation

3.2 Simulation & Aviation Disclaimer

simREF is a simulation-only product.

All procedures, checklists, and operational logic are provided for virtual aviation environments only and must never be used in real-world aviation.

3.3 No Affiliation

simREF is an independent project and is not affiliated with, endorsed by, or approved by:

  • Airbus S.A.S.
  • any aircraft manufacturer
  • any airline
  • any aviation authority

Any resemblance to real-world procedures or documentation serves simulation purposes only.

3.4 Availability & Warranty

simREF and all related services are provided “as is” and “as available”.

No warranties are given regarding:

  • accuracy
  • completeness
  • reliability
  • uninterrupted availability
  • suitability for a specific purpose

3.5 Limitation of Liability

To the maximum extent permitted by applicable law, ezy887 systems EU shall not be liable for any direct or indirect damages, including but not limited to:

  • loss of data
  • loss of progress or virtual achievements
  • incorrect simulation behavior
  • service interruptions caused by third parties (e.g. Apple, SimBrief, hosting providers)

Use of simREF is entirely at the user’s own risk.

3.6 Misuse & Abuse

Any attempt to:

  • bypass in-app purchase mechanisms
  • manipulate partner or Virtual Airline access
  • reverse engineer the application
  • exploit or distribute protected content

may result in restriction or termination of access, without prior notice.

4. Apple Platform & App Store Terms

4.1 Apple End User License Agreement (EULA)

Unless explicitly stated otherwise, use of simREF is additionally governed by Apple’s Standard End User License Agreement (EULA).

The Apple EULA applies in particular to:

  • license scope
  • usage rights
  • device limitations
  • restrictions and termination

4.2 App Store Transactions & Billing

All in-app purchases are processed exclusively through the Apple App Store.

Apple is solely responsible for:

  • payment processing
  • billing
  • refunds
  • subscription or purchase restoration

ezy887 systems EU does not have access to users’ payment data.

4.3 Refund Policy

Refund requests must be submitted directly to Apple and are subject to Apple’s refund policies.

ezy887 systems EU cannot issue refunds independently of Apple.

4.4 Apple as Third-Party Beneficiary

Apple and Apple’s subsidiaries are third-party beneficiaries of this Legal Notice and the applicable EULA.

Upon acceptance of these terms, Apple has the right to enforce them against the user as a third-party beneficiary.

5. Purchases & Access Models

5.1 In-App Purchase

simREF offers a one-time in-app purchase via Apple’s App Store.

Purchase availability and pricing may vary by region and are determined by Apple.

5.2 Preview Mode

simREF may be used in a preview mode with limited functionality.

Preview mode does not guarantee access to all features, procedures, or operator profiles.

5.3 Partner & Virtual Airline Access

Access may be granted through partner or Virtual Airline agreements.

Such access:

  • may be device-bound
  • may require eligibility criteria
  • can be revoked in case of misuse or violation of terms

6. Intellectual Property

6.1 Ownership

All original content, structure, logic, design, and software components of simREF are © ezy887 systems EU, unless explicitly stated otherwise.

6.2 Third-Party Trademarks and Logos

simREF may display third-party trademarks, airline names, aircraft types, and logos.

These are used:

  • solely for identification and simulation reference
  • based on publicly available sources (e.g. Wikipedia)
  • without claiming ownership, endorsement, or affiliation

All rights remain with their respective owners.

6.3 Content Creation Policy

Rules governing screenshots, videos, livestreams, and other publicly shared content created using simREF are defined in the simREF Content Creator Policy.

This policy forms an integral part of the legal framework and applies in addition to this Legal Notice.

7. Privacy Policy

7.1 Applicable Law

Data processing is conducted in accordance with:

  • the Swiss Federal Act on Data Protection (FADP)
  • the EU General Data Protection Regulation (GDPR)

7.2 Website Data Processing

Hosting & Infrastructure

  • Website hosted via Cloudflare Pages
  • Content delivery and security via Cloudflare

Analytics

  • Cloudflare Web Analytics
  • No advertising cookies
  • No cross-site tracking

Contact Form

  • Data submitted via the contact form is used exclusively to respond to inquiries
  • No newsletter or marketing usage

7.3 App Data Processing (simREF)

The following data may be processed locally on the user’s device:

  • SimBrief username
  • Virtual Airline pilot ID
  • device binding identifier (non-hardware, non-personal)
  • application settings and preferences

Additionally:

  • Apple Crash Reports may collect anonymized diagnostic information
  • No user accounts are created by ezy887 systems EU
  • No personal data is sold or shared

7.4 Third-Party Services

simREF interacts with external services, including:

  • Apple App Store services
  • SimBrief

Use of these services is subject to their respective terms and privacy policies.

7.5 User Rights

Users have the right to:

  • request information about stored data
  • request correction or deletion where applicable
  • object to data processing within legal limits
